Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SIMtrix platform ("Service"), operated by SIMtrix ("Company", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

SIMtrix is a relay platform that enables integration between Bitrix24 CRM and physical SIM cards on Android devices. The Service facilitates the transmission of SMS messages and phone calls initiated from or received by Bitrix24 through the user's own Android device and SIM card. SIMtrix acts solely as a technical intermediary — we do not originate, modify, or store the content of communications beyond what is technically necessary for relay purposes.

THE SERVICE OPERATES EXCLUSIVELY AS A RELAY MECHANISM. We do not control, endorse, or assume responsibility for: (a) The content of any SMS messages or phone calls transmitted through the Service; (b) The accuracy, legality, or appropriateness of any communications; (c) Compliance with telecommunications regulations in the user's jurisdiction; (d) The actions of the user's mobile carrier or Bitrix24 platform; (e) Any consequences arising from the use of the Service for marketing, commercial, or any other communications. You are solely responsible for ensuring that your use of the Service complies with all applicable laws, including but not limited to anti-spam legislation, telemarketing regulations, data protection laws, and telecommunications regulations in your jurisdiction.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. We make no guarantees regarding: (a) Service uptime or availability; (b) Message delivery success rates or timing; (c) Call quality or connection reliability; (d) Compatibility with specific Android devices or carriers; (e) Continued availability of any specific features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

You are responsible for maintaining the confidentiality of your account credentials, securing the Android device(s) connected to the Service, all activities that occur under your account, and ensuring that authorized personnel only have access to the administrative panel. You must immediately notify us of any unauthorized use of your account.

Paid features are billed through Stripe. Subscription fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice. Failure to pay will result in service suspension. Trial periods, if offered, convert to paid subscriptions automatically unless cancelled before the trial ends.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (a) We shall not be liable for any loss, corruption, or unauthorized access to data, including but not limited to SMS content, call recordings, contact information, or CRM data; (b) We shall not be liable for any indirect, incidental, special, consequential, or punitive damages; (c) Our total aggregate liability shall not exceed the amount paid by you for the Service in the 3 months preceding the event giving rise to the claim; (d) We are not responsible for data processed by third-party services (Bitrix24, Google/Firebase, Stripe, mobile carriers).

You agree to indemnify, defend, and hold harmless SIMtrix and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: your use of the Service; your violation of these Terms; your violation of any applicable laws or regulations; any content transmitted through the Service via your account; any third-party claims related to your communications.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. We are not obligated to retain any data associated with your account after termination.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively by the competent courts in Poland.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email or in-app notification.
